This website is operated by Florishaus, MB ("Floris Haus", "we", "us", or "our"). Throughout the site, the terms “you”, “your”, “customer” or “buyer” refer to the user of the site, whether simply browsing or completing a purchase or rental.
By visiting our website and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms”, “Terms of Service”, “Terms & Conditions”), including those additional terms, conditions, and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or content contributors.
Please read these Terms carefully before accessing or using our website. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. By accessing or using any part of the site, you agree to be bound by these Terms.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms & Conditions at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
1. TERMS OF THE AGREEMENT
Seller / Company – MB Florishaus, company code 307031439, registered office at Krivių g. 5, LT-01204, Vilnius, Lithuania.
Website / E-Store – The online retail platform accessible at www.florishaus.com through which customers may purchase or rent goods and services.
Buyer / Customer / User – A natural or legal person who purchases or rents goods or services through the Website. Buyers must:

A natural person of legal age and full legal capacity;

A minor aged 16 to 18 with parental or guardian consent (unless emancipated);
-
A legal entity;
-
An authorized representative of any of the above.
Parties – Collectively, the Buyer and the Seller.
Goods / Products – Any goods offered under this Agreement, including but not limited to individual artificial flowers, bouquets, vases, and related accessories.
Gift Coupon – A pre-paid voucher enabling its holder to acquire goods or services from Floris Haus under these Terms.
Value – The price assigned to each Product or service, used for damage assessment based on the Floris Haus quality standards, in the event of late return or damage.
Discount Code – A code issued by Floris Haus that grants a monetary or percentage-based discount. Each code may have an expiration date and can be either buyer-specific or general.
Deposit – A refundable sum charged individually per rental Item, covering minor damage as assessed by Floris Haus quality standards.
Evidence of Usage – Characteristics indicating use or damage, such as missing original packaging, odors, stains, breakage, color or shape changes, etc.
Order Package – The complete delivery package received by the Buyer upon delivery.
Special Offer – A promotion or deal displayed on the website that provides discounted or bonus services.
Personal Data – Information relating to an identifiable individual, including but not limited to name, email, phone number, and physical, physiological, or economic identifiers.
Rules – These Terms and Conditions, applicable to all transactions on florishaus.com.
Account – A user profile created by the Buyer on florishaus.com, which stores personal data and order history.
Privacy Policy – A separate document outlining the collection, processing, and storage of personal data by the Seller.
2. OBJECT OF THE AGREEMENT
These Terms and Conditions govern all sales, offers, services, deliveries, and agreements between Floris Haus (MB Florishaus) and the Buyer.
The Seller provides the following services:

Sale of artificial flowers, individual or in bouquets, with or without vases, made from materials such as silk and/or textile, plastic, etc.;

Rental of artificial flowers (hereinafter, “Items”) for a designated period;
-
Delivery services for purchased Items;
-
Delivery and collection of rental Items within Vilnius, Lithuania.
Floris Haus reserves the right to update these Terms at any time, with or without prior notice.
In case of discrepancies between these Terms and any individual agreement, the terms of the specific agreement shall take precedence.
Any deviation from these Terms is valid only if expressly confirmed in writing by MB Florishaus.
3. RENTAL SERVICES
3.1 General Conditions
Floris Haus offers artificial flower arrangements and related decorative items for rent. All rental periods must meet a minimum of 7 consecutive calendar days. The Buyer must contact hello@florishaus.com to confirm interest in renting items. Upon agreement, Floris Haus will provide the prices for the items, quantities, products, and rental timeline via email.
To confirm and schedule the rental order, the Buyer must:

Pay a deposit at the time of scheduling;
-
Pay the full rental fee at least 24 hours before the scheduled delivery.
-
If payment is not received by the specified deadline, the order will be canceled, and the deposit will not be refunded.

The Buyer must be available to collect the order on the scheduled date. If the Buyer fails to collect the order and does not notify Floris Haus via email to hello@florishaus.com at least 24 hours in advance, both the amount paid and the deposit will be non-refundable, in accordance with the cancellation and return policy.
3.2. Rental Conditions
By accepting the rental, the Buyer agrees to the following:

The rented items must be used exclusively for decorative purposes;
-
The items must not be exposed to excessive heat, open flame, water, or direct sunlight for extended periods;
-
The items must not be disassembled, altered, or misused in any way;
-
The items must be returned in their original condition and packaging.
The Buyer is fully liable for any damage to or loss of the rented items. The deposit is calculated individually based on the size of the order, type of flowers, and length of the rental period. It covers normal wear and tear, including but not limited to:
-
Slight petal or stem damage;
-
Minor staining or fading;
-
Normal handling wear.
Any damage or loss that makes the item unsuitable for future use or rental is considered beyond normal wear and tear and will incur additional charges. Specifically:
-
90% of the rental cost will be charged for each damaged item;
-
150% of the rental value will be charged for unreturned items;
-
€20 per missing packaging insert.
Floris Haus is not responsible for personal property returned unintentionally with the rented items. If the Buyer fails to settle the debt arising from damage or loss of items within 10 calendar days, the debt will be managed by third-party debt collection agencies.
3.3. Deposit Refund & Cancellation Policy
The deposit will be returned within 5 business days after collection, provided that all items and packaging are returned in satisfactory condition.

If the rental is canceled 10 or more days before delivery, the full deposit will be refunded;
-
If canceled 5 to 9 days before delivery, 50% of the deposit will be refunded;
-
If canceled less than 5 days before delivery, the deposit will not be refunded.
3.4. Collection & Return Logistics
The Buyer must be available to collect the order on the scheduled date. If the Buyer fails to collect the order and does not inform Floris Haus via email (hello@florishaus.com) at least 24 hours before the scheduled date, both the amount paid and the deposit will be non-refundable.
Returns must be coordinated via Floris Haus. Pickup and delivery is available only within Vilnius, Lithuania. Late returns will incur a pro-rated weekly fee, unless otherwise arranged.
4. SHIPPING & DELIVERY
4.1. Territory

Sales (purchases): Lithuania, Latvia, Estonia, Poland;

Rentals: Vilnius region only, unless otherwise agreed.
Shipping fees vary by country and are shown at checkout.
4.2. Order Processing
Orders are processed within 1–3 business days. You will receive email confirmation once your order is accepted and payment has been received.
Delivery typically takes 1–5 business days after dispatch, depending on destination.
A confirmation email with tracking info will be sent once your order is dispatched. Couriers may contact you directly to arrange delivery time.
4.3. Delivery Method
All orders are 100% tracked. You’ll receive an email with a tracking number and a link to track your parcel once your order leaves our warehouse. Please allow 24-48 hours for the tracking link to start showing shipping information.
It is the Buyer’s responsibility to provide accurate and complete delivery details. Floris Haus is not liable for delays or losses caused by incorrect information.
5. BUYER'S RIGHTS & OBLIGATIONS
5.1. Rights
The Buyer has the right to:

Access clear, accurate, and comprehensive information about the Goods, including pricing, availability, and specifications.

Purchase or rent Goods under the terms and conditions outlined herein, ensuring that all transactions are made in accordance with these Terms and Conditions.

Withdraw from the agreement within the statutory cooling-off period as per applicable law, subject to the conditions set forth in the Terms and Conditions.

Return faulty, incorrect, or unwanted Goods in compliance with the regulations set forth by law and as specified in the Return and Refund Policy.

Receive timely customer service assistance, including support for any inquiries, issues, or concerns regarding the Goods, services, or the ordering process.
5.2. Obligations
The Buyer is obliged to:

Provide accurate, current, and complete information when placing an order, including but not limited to personal details, payment information, and delivery instructions.

Ensure that the use of the Website and any services provided by florishaus.com complies with all applicable laws, including local, national, and international regulations.

Refrain from engaging in any behavior or activities that may disrupt, damage, or interfere with the normal operation and functioning of the Website, including any form of hacking, spamming, or attempting to bypass security protocols.

Pay all applicable fees in full and on time, including but not limited to the price of the Goods, delivery fees, rental deposits, and any additional charges for damages, loss, or other financial responsibilities as set forth in these Terms and Conditions.

Ensure that any third parties acting on the Buyer’s behalf or using the Buyer’s account for orders comply with these Terms and Conditions.

Maintain the confidentiality of login information and ensure that their account is not misused or accessed by unauthorized individuals.

Notify florishaus.com immediately if there are any errors, discrepancies, or concerns regarding an order, transaction, or delivery to ensure swift resolution.

In the case of a dispute or legal claim, cooperate fully with florishaus.com in providing necessary information, documents, and evidence to resolve the issue promptly and in good faith.
6. SELLER'S RIGHTS & OBLIGATIONS
6.1. Rights
The Seller has the right to:

Clearly and comprehensively provide the Buyer with accurate information regarding the conditions of service provision, item characteristics, pricing, delivery and return processes, payment procedures and deadlines, and compensation policies.

Ensure that the items ordered by the Buyer correspond to the information provided on the Website and are in suitable condition for use, as specified.

Suspend or terminate the activities of florishaus.com at any time, with the condition that all accepted and confirmed orders will still be completed, but no new orders will be accepted.

Unilaterally terminate the Agreement in cases of unforeseen circumstances, such as situations that prevent the Seller from delivering the ordered item. In such cases, the Seller will notify the Buyer in advance and offer a replacement item at no additional cost if a similar item is available.

If the Seller cannot offer a replacement or if the Buyer declines the offer, the Seller will refund the payment within 5 (five) working days from the notification of the termination, which will be considered full and proper fulfillment of the Seller's obligations. The Seller will not be held liable for any damages to the Buyer or third parties in this case.

Modify or discontinue any part of the Service (or the entire Service) without notice at any time, including prices or content.

Modify product prices without prior notice. The Seller will not be liable for any modifications, price changes, suspensions, or discontinuances of the Service.
6.2. Obligations
The Seller is obliged to:

Provide the Buyer with clear and accurate information about the products and services offered, ensuring transparency in all details, including prices, availability, delivery, and return policies.

Provide the Buyer with access to the services and products offered through florishaus.com, according to the conditions set out in these Terms and Conditions and related documents.

Process and protect the Buyer’s personal data in accordance with the applicable Privacy Policy, Terms and Conditions, and relevant legislation, ensuring that the Buyer’s privacy is respected at all times.

Comply with the obligations imposed by the Civil Code of the Republic of Lithuania and any other applicable legal acts, ensuring that all actions and transactions are carried out in accordance with the law.

Provide the Buyer with clear and understandable information as required by Article 6.2287 of the Civil Code of the Republic of Lithuania.

Fulfill any other duties specified by the Terms and Conditions, Privacy Policy, and applicable laws.
7. PRICES & PAYMENT
All prices are in EUR and include VAT, unless stated otherwise. If viewing from Poland, prices may be displayed in PLN.
Payment options include:

Online banking (via payment gateway);

Credit/debit card;
-
Manual bank transfer (processing may take longer).
Orders will not be confirmed or fulfilled until full payment has been received.
8. CANCELLATIONS, RETURNS & EXCHANGES
8.1. Right to Cancel
You have the right to cancel a purchase (not rental) within 14 days of receipt, without stating a reason, provided the item is:

Unused and in resellable condition;

In its original packaging;
-
It is not a product that has been made or adapted specifically for the Customer;

The Customer has not waived their right of withdrawal.
Please email us at hello@florishaus.com to request a return authorization. No returns or exchanges will be accepted without prior authorization.
Returns must be shipped at your expense and include tracking. No returns or exchanges will be accepted without prior authorization. Customers are responsible for return shipping costs and any associated customs and/or duties. Once authorized, items must be shipped to the address provided within 14 days. Returned items are your responsibility until they reach us.
Please use a tracked shipping method. We are not responsible for lost packages if there is no tracking code.
8.2. Exemptions
Returns are not accepted for:

Custom or made-to-order pieces;
-
Gift vouchers;
-
Items damaged after receipt by the Buyer;
-
Rental orders.
8.3. Refunds
Once your returned item is delivered to us, our team will inspect it to ensure it meets our return criteria. This process may take up to 5 business days. If your return is approved and no exchange is initiated, you will receive a confirmation of your refund. Approved refunds will be issued within 5 business days of returned item inspection.
Funds will be refunded via the original payment method unless otherwise agreed.
9. FAULTY OR DAMAGED ITEMS
If your order arrives damaged or faulty, please contact us at hello@florishaus.com within 3 calendar days of delivery. Include your order number, a description of the issue, and clear photographs of the item and its packaging. Claims submitted after this period may not be eligible for a refund or replacement.
Depending on the nature of the issue, you may be offered one of the following resolutions:

Free repair;
-
Replacement with an identical or similar item;
-
Partial refund, if the item is still usable;
-
Full refund if the item is materially defective;
-
A gift coupon of equal value to be used on a future order.
We are not responsible for any damage caused after delivery due to misuse, improper handling, or unsuitable storage conditions.
The Buyer retains rights under Lithuanian consumer protection law. Remedies will depend on:

The value of the goods if they were not defective;
-
The severity and nature of the defect;
-
Whether repair or replacement is possible without disproportionate cost or delay.
If a suitable solution cannot be offered in a reasonable timeframe, the Buyer may request a price reduction or cancel the purchase.
To initiate a claim, the Buyer must notify us in writing and provide proof of purchase and visual evidence of the issue. Refunds, exchanges, or vouchers will not be issued without proper documentation.
We do not accept cancellations or issue compensation for minor defects or if the claim is made after the 3-day notification period.
If the item is confirmed to be defective or damaged upon arrival, return shipping or pickup will be covered by Floris Haus. We will provide you with a prepaid return label or organize a courier collection where applicable. You will not be asked to cover return costs in such cases.
10. PRODUCTS AND GIFT COUPONS
10.1 Poducts
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
10.2. Gift coupons

Are valid for 12 months from the date of purchase;

Cannot be exchanged for cash;

Must be used in a single order if the balance is lower than the item total;

Cannot be used after their expiration date.
11. INTELLECTUAL PROPERTY
All intellectual property rights related to goods and services remain the property of Florishaus MB. The Customer may not use the name and/or logo of Florishaus MB for its own commercial purposes or in any expression unless prior written permission is granted by Florishaus MB.
The Agreement does not include the transfer of intellectual property rights from Florishaus MB to the Customer as part of the delivery of goods or services, including related documents. The Customer may not copy, modify or distribute the delivered goods or services without prior written permission from Florishaus MB.
12. DISCOUNT CODES & GIFT CARDS
From time to time, florishaus.com may offer limited-time promotional vouchers and discounts. These vouchers and discounts can be used to obtain a reduction in the price of certain items, subject to the terms and conditions associated with each promotion.
Such offers:

Cannot be combined unless explicitly allowed;
-
Must be used before the expiry date;
-
May be revoked if used fraudulently.
We reserve the right to cancel any order suspected of misuse or abuse of discount codes.
Virtual gift cards are sent to the email within 24 hours of making a payment. Gift cards are non-refundable and cannot be exchanged for cash in part or full. Gift cards are applied to the final order total. They can be used more than once, provided there is still balance remaining on the card. Gift cards can not be used past the expiration date.
13. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Floris Haus, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. 18. ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
